Terms and Conditions
RESERVATION POLICY
- For houses #1 though #7, guests that make their reservation at least 15 days before their check-in date will have their card charged 20% of the reservation total. The remaining 80% will be charged 14 days prior to the check-in date. Guests that make a reservation within 14 days of their check-in date will be charged the total amount at the time of reservation.
- For houses #8 though #11, guests that make their reservation at least 31 days before their check-in date will have their card charged 20% of the reservation total. The remaining 80% will be charged 30 days prior to the check-in date. Guests that make a reservation within 30 days of their check-in date will be charged the total amount at the time of reservation.
- Should the credit card used to make the reservation fail when processing the final 80% payment, Mountain Shire will send the guest a new payment link via email and text. If payment is not received within 3 days of sending the link, the reservation will canceled and no refund for the initial 20% down payment will be issued.
CANCELLATION POLICY
- Cancellation requests MUST BE sent via email to justin@mountainshiretn.com
- While we understand that emergencies can happen to anyone, exceptions to the cancellation policy are not given.
- Please consider purchasing travel insurance for your trip. This is the best way to protect against unforseen disruptions and emergencies.
- Purchase travel insurance for direct-booked rentals via providers like RentalGuardian, Allianz, or Generali to cover cancellations, medical emergencies, and damage protection.
Cancellation Policy for Houses #1 through #7
- Cancellation up to 14 days before arrival date - 100% refund (e.g. if you are scheduled to arrive on September 20, the latest possible time to cancel would be September 9 11:59pm for a full refund)
- Cancellation up to 7 days before arrival date - 50% refund (e.g. if you are scheduled to arrive on September 20, the latest possible time to cancel would be September 14 11:59pm for a full refund)
- Cancellation within 7 days before arrival date - Cleaning fee and pet and early arrival fees (if applicable) refunded
- Requests to reschedule must be submitted before the 14-day cancellation deadline for your original arrival date. Rescheduling requests received after the cancellation deadline will not be accommodated, and the reservation remains subject to the cancellation terms in effect at the time of the request.
- No refund ($0) given for direct bookings on the Mountain Shire website for no shows or cancellations on day of arrival or after

INCLEMENT WEATHER POLICY
- In the event of snow fall of more than 5 inches or forecasted sub 20°F temperatures for several days (i.e. prolonged polar vortex) we may need to cancel reservations for safety reasons. Full refunds will be issued when this happens.
- Weather events in other areas of the country but not affecting Mountain Shire will not warrant a refund (e.g. wildfire in California, flooding in Virginia, or snow storm in Ohio). Similarly, routine or normal winter weather for our area of Tennessee does not qualify for a refund. If you are uncomfortable with even small amounts of snow or cold temperatures, you should not make a reservation to visit Mountain Shire from mid December to early March, as winter weather is possible.
- We are located directly off of a main road, Wears Valley Rd., which is prioritized by the county for salting and snow removal. During winter weather, the best route to take to get to Mountain Shire is I-40 to 66 (Winfield Dunn) to 441 (The Parkway) to Wears Valley Rd. These are primary roads and are salted and plowed. Secondary and private roads may or may not be salted and/or plowed.
PETS
Dogs (and cats) are welcome at Mountain Shire. The fee is $79 or $99 per stay, depending on the house. Max weight per pet is 75 lbs. Pets must be crated while alone in the tiny houses. Any damage to the exterior or interior of the premises, grounds, flooring, walls, trim, finishes, rugs, furnishings, or any stains, etc., caused by the pet will be the full financial responsibility of the guest and that guest agrees to pay all costs involved in the restoration to its original condition. If because of any such stains, etc., said damage is such that it cannot be removed, then resident agrees to pay the full expense of replacement.
SMOKING
All of our tiny houses are 100% non-smoking (this includes tobacco, vape and marijuana). Any violation of the smoking policy indoors will be charged a $500 additional Cleaning Fee to remove smoke odors from the home and/or linens.
ITEMS LEFT BEHIND
Mountain Shire shall not be liable or responsible for personal items left behind, lost or stolen. If you leave an item after checking out and wish to have it returned, call Mountain Shire (443-254-0524) as soon as possible and we will arrange for shipment. We will take the item to UPS where you will have to arrange for shipping.
DAMAGE
While accidents do happen, registered guests will be held financially responsible for all damages to the property or missing items discovered during their stay and/or immediately upon departure.
LIABILITY
And here’s the extra fine print… Mountain Shire ("Mountain Shire" includes the following: (a) Mountain Shire and (b) the owners of the tiny houses on Mountain Shire property) accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, pandemics, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures. Mountain Shire will not be responsible for the loss or damage of any property left in a tiny home other than as required under Tennessee law. Mountain Shire will not be liable for any indirect, consequential loss or pure economic loss (whether caused by the negligence of the Company, its employees, contractor or agents or otherwise). The Company’s total liability shall not exceed the value of the Contract. Nothing contained in these terms and conditions may be read or construed as excluding any liability for death or personal injury caused by Mountain Shire’s negligence or liability for fraud or fraudulent misrepresentation. These terms and conditions will be governed by and construed in accordance with the laws of the state of Tennessee, without regard to conflict-of-laws principles.
GOVERNING LAW & JURISDICTION
This Contract shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of laws principles. Any disputes, claims, or legal proceedings arising out of or relating to this Agreement, the rental of the property, or any related matters shall be resolved exclusively in the courts located in Sevier County, Tennessee. The parties hereby consent to the personal jurisdiction and venue of such courts and waive any objections to jurisdiction or venue therein. In the event of arbitration, the arbitration shall take place in Sevier County, Tennessee, in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The prevailing party in any litigation or arbitration shall be entitled to recover reasonable attorneys’ fees and costs.
